H&W Strategies is a specialized brokerage and consulting firm providing Health & Welfare (H&W) benefit solutions funded with fringe dollars for government contractors operating under the McNamara-O’Hara Service Contract Act (SCA) and the Davis-Bacon and Related Acts (DBA). We support contractors across both the service and construction industries, delivering compliant, defensible benefit strategies that satisfy federal prevailing wage and fringe benefit requirements while maximizing fringe dollar efficiency.

Under SCA and Davis-Bacon wage determinations, contractors must furnish required fringe benefits separate from and in addition to hourly wages, on an individual employee basis, and in accordance with U.S. Department of Labor (DOL) regulations. These obligations may be satisfied only through bona fide fringe benefit arrangements, which the DOL evaluates based on funding structure, enforceability, documentation, fiduciary responsibility, and ongoing reporting obligations.

Small Businesses

Funded Fringe Benefit Plans

H&W Strategies specializes in the design, brokerage, and placement of funded H&W plans, which are generally the preferred method for satisfying federal fringe obligations. Funded plans require irrevocable contributions made on behalf of covered employees to an independent third party—such as an insurance carrier or trust—under a written plan with a primary purpose of providing benefits to workers. These arrangements must be legally enforceable, non-reverting to the contractor, and administered in compliance with applicable fiduciary standards and ERISA reporting requirements. Properly structured funded plans allow contractors to efficiently meet fringe requirements while reducing audit exposure and long-term liability.

Larger Businesses

Unfunded Fringe Benefit Plans

H&W Strategies also advises contractors on unfunded (self-insured) fringe benefit plans, which involve paying benefits out-of-pocket as costs are incurred rather than through advance funding. Under DOL regulations, unfunded plans are not generally considered bona fide for SCA or Davis-Bacon purposes—except in limited circumstances such as vacation or holiday benefits—and typically require advance approval from the Department of Labor. We assist contractors in evaluating whether an unfunded approach is viable, preparing required documentation, and navigating the DOL approval process when applicable, while clearly outlining the compliance risks, reporting obligations, and administrative considerations associated with these arrangements.
